TERMS OF SERVICE

please read all of this before making an order !

This contract applies to the artist, called the Artist, and the individual or organisation, called the Customer, who is purchasing a work of art, called a Commission (and product), from the Seller. By ordering a Commission, the Customer agrees to the following terms and conditions :

SIMPLIFIED TOS

NOTICE - this is a condensed version of the tos and may miss detailed info. The full tos still applies to your order/s

01 . Pay upfront for orders below $80 AUD
02 . The product will be delivered digitally via email
03 . The Customer has the right to ask for three complete revisions during the sketching phase at maximum
04 . The Customer has the right to request a reasonable amount of minor edits
05 . All orders must be paid in AUD
06 . The Customer can ask for a refund when no progress has been given for two months, or when no product is delivered in four months
07 . The product cannot be used commercially without mutual agreement between the Artist and Customer beforehand
08 . The Customer is required to respond to the Artist in a fast and concise manner. No response for 48 hours will be read as implicit approval
09 . The Artist can cancel the order any time
10 . The Customer has no right to use the product in any AI-related technology, nor blockchain-related technology, whether present or future

PAYMENTS & CONVERSIONS

01 . Customer agrees to pay the total amount specified in AUD
02 . Customer agrees to pay the entire Commission price upfront if below $80 AUD
03 . On orders above $80 AUD, Customer agrees to pay half of the invoice total upfront. The other half is to be paid on the approval of the initial sketch
04 . Detailed designs may lead to a maximum of 10% uptick in price, and the opinion on whether the designs are detailed or not are up to the Artist
05 . In YCH (Your Character Here) Commissions, if the order is above $80 AUD, rule 02 does not apply, therefore meaning the Customer must pay the entire price upfront
06 . Customer accepts that the Commission will not commence till payment is given, and if the total amount of money in AUD received on the Artists account is equal to the invoice amount in the Customer's given currency
07 . Any other method of payment must be mutually agreed upon by both Artist and Customer
08 . It is the sole responsibility of the Customer to bear any costs related in transferring money to the Artist

PRODUCT DELIVERY

01 . Customer agrees that the completed Commission will be delivered digitally via an email address provided by the Customer AFTER the final payment has been received by the Artist.
02 . Any other method of delivery, whether digital or physical, must be mutually agreed upon by both Artist and Customer. Customer is then obliged to bear any costs incurred upon alternate delivery such as postal, material, and subscription fees
03 . It is the sole responsibility of the Customer to store the Commission properly. The Artist cannot be held responsible to a loss of product due to negligence, and it will not be reimbursed. The Artist cannot guarantee that the original copy of the product will be available if the Commission is lost
04 . It is the sole responsibility of the Customer to propose an appropriate delivery method which works for both parties. The Artist cannot be held responsible for occurrences outside of the Artist's responsibility, such as the loss of access to delivery method or mail filters

REVISIONS & REFUNDS

01 . The Customer has the right to ask for Commission revisions before the flat colour phase. The Customer can only ask for three complete revisions during the sketching phase
02 . The Customer has the right to request for reasonable minor detail changes after the Commission is completed. Anything further will result in additional payment, and the work on any excessive requests will not commence till payment is given
03 . The Customer has the right to request a refund if no progress is given within a span of two months (60 days), or when the work has not been completed in four months (120 days) unless discussed between the Artist and Customer beforehand. Refund conditions for Commissions which require more work must be agreed separately before work has begun. These provisions exclude work interruptions caused by unforeseen circumstances such as illness, school, or any other credible reason
04 . The Customer is obliged to contact the Artist as soon as they can, responding swiftly to any requests, comments, clarifications, opinions, validations of progress, etc. If no appropriate response is given within 48 hours, it will be recognised as implicit approval of the progress and current state of the Commission

PERSONAL & COMMERCIAL USE

01 . The product received by the customer, whether digital or physical, is for personal use only. Any commercial purposes, resells, reproduction or publishing for reasons outside of personal usage must be agreed upon by the Artist
02 . The Customer has no right to use the product for AI datasets, AI tools and any present or future inventions in the space or use the product in block-chain related technology, such as NFT's, cryptocurrency and future inventions in the space
03 . The Artist maintains the right to post the Commission to their social media platforms with appropriate watermarking for advertising. The Customer is free to request for this advertisement to not occur
04 . If the Customer wishes to post the Commission to their own social media platforms, it must be appropriately credited to the Artist with either a username/s and social media platform/s name, or a link to the Artist's social media platform/s. This includes in using the Commission in situations such as a banner or profile picture

CANCELLATIONS

01 . The Artist has the right to refuse or cancel any order with no reason required with a full refund, unless if the Commission has reached the flat colours stage or onwards. This will then lead to an 80% refund
02 . Disrespectful behaviour will not be tolerated and may result in the cancellation of an order. The Customer will receive a full or partial refund depending on the amount of work completed and will be decided upon during the moment. The Artist has the right to refuse any future service to the Customer in the future
